SUBLIMNL (Subliminal LA, “we,” “us,” or “our”) is based in California. This Privacy Policy explains how we handle personal information when you visit our Shopify store, shop with us, subscribe to messages, or contact us. It also explains your privacy choices. Our Privacy Policy governs personal information if it conflicts with our Terms & Conditions.

Information we collect and why

Depending on your interactions with us, we collect the following categories from you, automatically from your device, and from Shopify, payment and shipping providers, Klaviyo, and advertising providers supporting the store:

Identifiers and contact information: your name, email, telephone number, billing and shipping addresses, account identifiers, IP address, and cookie identifiers. We use these to manage accounts, fulfill orders, provide support, recognize preferences, prevent fraud, and send permitted communications.
Order and payment information: products purchased or returned, cart contents, order history, payment status, and transaction details. Payment providers process payment credentials to complete purchases. We use order records for fulfillment, customer service, accounting, and legal obligations.
Internet activity and approximate location: pages and products viewed, device and browser details, referring pages, interactions with our store or messages, and a general location inferred from an IP address. We use these for store functionality, analytics, security, and advertising subject to your choices.
Communications and preferences: information you send in support requests, marketing consent records, and inferred product interests. We use these to answer you, maintain your preferences, and tailor permitted marketing.

Please provide only information needed for your request. We do not ask for government identifiers, health information, or precise location for ordinary shopping. Payment or account credentials that may be sensitive under privacy law are used to process payments, secure accounts, and provide requested services, not to infer sensitive characteristics.

How information is disclosed

We disclose relevant information to Shopify and service providers that help host and operate the store, process payments, ship orders, provide analytics, support customers, and deliver marketing through Klaviyo. We also disclose information to advertising partners for the advertising purposes described below, subject to your choices. Providers receive information needed for their roles. We may disclose information when you direct us to, to comply with valid legal process, to investigate fraud and protect rights, or in a merger, acquisition, or business transfer subject to applicable protections.

We do not sell customer lists for money. However, sharing identifiers, shopping activity, and inferred interests with advertising services can be a “sale” or “sharing” under California law even without a monetary payment. Shopify and Klaviyo

Shopify hosts our store and processes information to operate and improve its services. Shopify Network Intelligence is enabled: certain enhanced services may use information about your interactions with our store together with activity involving other merchants and Shopify for personalization, advertising, and service improvement. Shopify is responsible for its processing for those enhanced services and the associated privacy requests. See the Shopify Consumer Privacy Policy and Shopify Privacy Portal.

We use Klaviyo for marketing and related analytics. Subject to your choices and applicable law, contact details, purchases, browsing activity, cart activity, and message interactions may be used to personalize communications and measure performance. If you opt into a text program that includes cart reminders, cookies and cart activity may help determine when to send those reminders. SMS consent and mobile opt-in information are not shared with third parties for their own marketing; they may be shared with providers that deliver or support our messaging program.

Cookies, tracking, and your choices

Our store and its providers use cookies, pixels, and similar technologies for cart and checkout functions, security, preferences, analytics, and marketing. Advertising providers may collect information about your activity over time and across other websites or services for interest-based advertising. You can manage cookies through your browser and through any cookie preferences presented on the store. Blocking essential cookies may affect checkout or account features.

California visitors can use Your Privacy Choices without creating an account. Shopify’s privacy controls recognize the Global Privacy Control (GPC) signal as an opt-out of sale/sharing for the browser and device in regions where our opt-out page is active, including California; where Shopify can associate the signal with an account, it also applies the request to that account. Other browser “Do Not Track” signals do not currently change our practices. A browser-based choice may need to be repeated if you change browsers or devices or clear cookies. Unsubscribe from marketing emails using the link in a message. If you subscribe to marketing texts, reply STOP to the sending number to opt out or HELP for assistance. You may also email us. Marketing opt-out does not prevent necessary order or account communications. Purchasing or browsing does not by itself constitute consent to marketing texts.

California privacy rights

Where the California Consumer Privacy Act, as amended by the California Privacy Rights Act, applies to our processing, California residents have rights to know/access the personal information collected about them and its sources, purposes, and recipients; obtain a portable copy; request deletion, subject to exceptions; correct inaccurate information; and opt out of sale or sharing. A right to limit certain uses or disclosures of sensitive personal information also applies when that information is used beyond legally permitted purposes. We do not use sensitive personal information to infer characteristics about you. We will not unlawfully discriminate against you for exercising privacy rights.

The categories, sources, uses, and recipient types above describe the store’s current data practices. We handle identifiers, customer-record information, commercial information, internet activity, approximate location, communications, and inferences as relevant to the services you use. Identifiers, commercial information, internet activity, approximate location, and associated interests may be disclosed for advertising that qualifies as sale/sharing. Payment credentials and SMS consent are not provided to advertising partners for their independent marketing.

To request access, correction, or deletion, email info@sublimnl.co with “Privacy Request” in the subject line. You can email us even if a particular statutory right does not apply; we will explain the available options. We may verify requests using information already associated with your account or order. Do not send a password, full payment-card number, or government ID by email. Authorized agents may submit requests with evidence of permission; we may need to verify you directly where permitted. Opt-out requests do not require identity verification.

For requests governed by the CCPA, we acknowledge requests to know, delete, or correct within 10 business days and generally respond within 45 calendar days. If a permitted extension is needed, we explain it within that period. We process sale/sharing opt-outs as soon as feasible and within the applicable legal deadline. Some records may be retained for legal, security, or transaction-related reasons. You may also request information about disclosures for third parties’ direct marketing under California’s “Shine the Light” law by contacting us.

Retention and security

We retain each category only as long as reasonably needed for its purpose: order and payment records for fulfillment, accounting, disputes, and legal obligations; account details while needed to maintain the relationship; support records to resolve and document requests; and marketing preferences, consent, and suppression records to honor your choices. Technical and activity records are retained as needed for operations, security, and permitted analytics or advertising. Retention depends on the record’s purpose, legal requirements, and whether a dispute or investigation is ongoing. No internet transmission or storage method is completely secure.

Children, international processing, and other websites

Our store is intended for a general audience and is not directed to children under 13. We do not knowingly collect personal information from children under 13 or sell/share information about anyone we know is under 16. Contact us if you believe a child has provided information so we can investigate and take appropriate action.

We are based in the United States. Shopify and our providers may process information in other countries, subject to applicable transfer requirements. If privacy laws where you live provide additional rights, contact us to exercise them or raise a complaint. Links to other websites are subject to those operators’ privacy practices.
